  • On October 24, 2013, Donna Shahrabani was a featured speaker at the Annual Conference and Expo of the New Jersey Chapter of the Community Associations Institute held at Revel in Atlantic City. Ms. Shahrabani spoke at a seminar entitled “Common Interest Meetings in a Modern Age.” Ms. Shahrabani discussed the use of technology and how it impacts a community association and its governing board.   • Buckalew Frizzell & Crevina is pleased to announce that R. Bruce Freeman, Esq., formerly a partner in the firm of Woehling & Freeman, has joined the firm as Of Counsel. Mr. Freeman has concentrated his practice in the area of community association law since 1975, and is a member of the Community Associations Institute's College of Community Association Lawyers. He has lectured and written widely on various issues affecting community associations, and his articles have appeared in The Journal of Community Association Law, Community Trends magazine, Habitat magazine, the National Law Review Reporter, the Real Estate Lawyer and the Zoning and Planning Law Handbook. He has also served as Chairman, Vice Chair and Legislative Liaison for the Common Interest Ownership Committee of the New Jersey State Bar Association, and has served on the Editorial Board of the Journal of Community Association Law as well as in various capacities with the New Jersey Chapter of CAI.

November 2012

  • On November 15, 2012, Donna Shahrabani was a featured speaker at a CAI-NJ seminar entitled, "Your Community Association Documents: What You Don't Know Can Hurt You." Ms. Shahrabani discussed various provisions contained in governing documents of community associations which may not be obvious or understandable to a board comprised of lay persons, and addressed the ramifications of not being aware of such provisions. The seminar was attended by board members, property managers and other attorneys.

October 2012

  • Eric Frizzell was quoted at length in the October 2012 edition of The New Jersey Cooperator in an article entitled “Fiduciary Duty — What Boards & Owners Should Know.” The article discusses important legal principles pertaining to the fulfillment by association Board members of their fiduciary duty to their associations and homeowners.

July 2012

  • Martin N. Crevina, a partner at BF&C, won a judgment of $3,899,532 for construction defects and accounting deficiencies against the sponsor of a converted condominium high-rise in Jersey City. After entering default against the sponsor and holding a contested proof hearing, the court held the sponsor liable for defects in the construction of the condominium, finding that the engineering report that the sponsor included in its Public Offering Statement was deficient because it did not adequately disclose the existing conditions of the condominium at the time of the conversion. The court also awarded the Association almost $2.1 million on its claim that the sponsor underfunded the Association's replacement reserves. In a ruling of significance to associations that have been the victim of a sponsor's inadequately funded replacement reserves, the court held the sponsor liable for the difference between its replacement reserve schedule and the schedule prepared by the Association's engineer - for the full useful life of each component in the reserve study.

Ms. Siegel, who joined the law firm as an associate in 2002, represents numerous community associations and is active in the law firm's commercial and construction litigation practices. Ms. Seiter, who joined the firm in 2003, represents many community associations and concentrates her practice on the transactional side, with substantial involvement in the process of transition from developer control and the remediation of construction defects.

Mary Wynn has been an associate with the law firm since April 2003. She is extensively involved in all aspects of representing community associations in transition from developer control, including negotiating the resolution of construction defect claims against developers.
